These Terms govern your use of The Claritecture Method and all related services. By accessing our platform, you agree to these Terms.

1. Eligibility and Age Restriction

You must be at least 18 years old to use this Service.

By creating an account, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into this agreement
• You will not allow anyone under 18 to access or use your account

This age restriction is in accordance with the UK Online Safety Act 2023.

2. Account Responsibilities

• Maintain secure login details
• Notify us of unauthorised use
• Do not share or resell your access

3. Acceptable Use

You must not:

• Upload harmful content
• Misuse AI systems
• Attempt to access restricted material
• Reverse engineer prompts or system structure
• Behave in ways harmful to the learning environment

4. AI-Generated Content and Professional Advice Disclaimer

AI output may contain errors or outdated information. You remain responsible for decisions made using AI tools.

5. Suspension and Termination

We may suspend or terminate accounts that breach these Terms. Upon termination:

• Your access to the Service will end
• Your data may be deleted according to our retention policies
• Any unused subscription period will be refunded on a pro-rata basis (consumer accounts only)

Terms of Sale

These Terms cover the sale of digital products and subscriptions by Claritecture Studio Ltd.

6. Digital Products

• The Claritecture Method is a one-time purchase with lifetime access
• Tier 2 includes the Claritecture AI Guide

7. Payments

Payments are handled by Stripe. We do not store card details.

Prices are displayed in USD and may change with at least 30 days' notice.

8. Consumer Rights and Cancellation

For consumers in the UK and EU:

14-Day Cooling-Off Period: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have 14 days from the date of purchase to cancel and receive a full refund.

For The Claritecture Method (digital course): If you request immediate access to the course upon purchase and begin accessing content during the 14-day period, we may deduct a proportionate amount from your refund to reflect the content accessed. See our Refund Policy for details.

Your Statutory Rights: Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, including your rights to:

• Digital content of satisfactory quality
• Digital content fit for a particular purpose
• Digital content as described
• A price reduction or refund if digital content does not meet these standards

9. AI Guide Subscription

AI Guide subscriptions (included with Tier 2) renew automatically unless cancelled. Cancellation stops the next billing cycle. You retain access until the end of the current billing period.

Limitation of Liability

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded by law
• Breach of your statutory rights under the Consumer Rights Act 2015

Subject to the above:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the greater of: (a) the amount you paid for the Service in the past 12 months, or (b) GBP 100
• We are not responsible for third-party services (AI providers, Stripe)

If you are a consumer, these limitations apply only to the extent permitted by applicable consumer protection law.

Indemnification

For business users only: If you use the Service for business purposes, you agree to indemnify and hold harmless Claritecture Studio Ltd from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

This indemnification clause does not apply to consumers.

Data Processing and Security

Claritecture Studio Ltd maintains administrative, technical and physical safeguards to protect user data including:

• Encrypted storage and transmission
• Secure hosting on Cloudflare
• Audit logs
• Access controls
• Separation of AI systems
• Routine security monitoring

Your use of the Service is governed by our Privacy Policy.

Intellectual Property

All course materials (including course scripts, workbooks, templates, cheat sheets, video content, AI system prompts, modes and design frameworks) are published and operated by Claritecture Studio Ltd.

All underlying intellectual property remains the property of the original creator and is not transferred to Claritecture Studio unless explicitly assigned in writing.

You may not copy, resell, republish or train AI systems on this intellectual property.

You retain ownership of work you produce using the method.

Service Availability and Changes

• We aim to provide reliable service but do not guarantee 100% uptime
• We may perform maintenance that temporarily affects availability
• We may modify or update course content to improve the learning experience
• We may discontinue features with at least 30 days' notice for material changes
• If we discontinue the Service entirely, we will provide at least 60 days' notice and offer data export options

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

For consumers: You may bring legal proceedings in the courts of England and Wales, or in the courts of your country of residence. If you are resident in the EU, you may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

For business users: Any disputes will be resolved exclusively in the courts of England and Wales.

Nothing in these Terms affects your statutory rights as a consumer under UK or EU law.

Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email at least 30 days before they take effect.

If you do not agree to the updated Terms, you may cancel before they take effect.

General Provisions

• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
• Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Claritecture Studio Ltd regarding the Service.
• No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights to any successor entity.
